To the extent permitted by law, ProxyElite.biz and the parties released from liability hereby disclaim all warranties, express or implied, including, without limitation, warranties of non-defect, merchantability, fitness for a particular purpose or non-infringement of third party rights. You assume all risk with respect to the use of communications for your purposes and with respect to the quality and performance of communications, including, without limitation, the risk of deletion or damage to your software, hardware or content, or unauthorized access by unauthorized persons to your information, as well as abuse or illegal possession of your submission by other users. This restriction applies in situations where there is no substantial application of any remedies. Some jurisdictions do not allow the exclusion or limitation of implied warranties, so this disclaimer may not apply to you.

Except as required by law, ProxyElite.biz and the parties released from liability are not liable for any direct, indirect, actual, real or incidental damages incurred as a result of or in any connection with these terms of use or the inability to use communications, including, without limitation, direct and indirect damages from-for loss of reputation, lost profits, data loss and computer failure or malfunction, even if it was known about the possibility of such losses, and regardless of the theory (contract, tort or other) on which the claim is based. The aggregate liability of proxyelite. biz and the parties released from liability under this agreement does not exceed $500 (five hundred dollars). Compensation of losses

You agree to protect, indemnify and hold harmless ProxyElite.biz, its contractors, employees, licensors and partners, as well as their respective directors, officers, employees and agents ("parties exempt from liability") from any third party claims and expenses (including legal fees) arising from your use of our communications (including, without limitation, your submissions or your violation of any of these terms).
